Professor Richard Marsico
This
course covers constitutional issues in public education law. Topics
include the history and purpose of public education; constitutional
foundations for federal involvement in education law; the Equal Protection
Clause and its application to school desegregation, affirmative action, and
gender discrimination in public schools; student First and Fourth Amendment
rights; and the Establishment and Free Exercise Clauses in public schools,
including their application to the use of public resources for religious
education, prayer in public schools, teaching creationism and evolution,
and religious use of public school facilities. Students will be graded
based on class participation and a final exam.
