This course assumes that students understand the basic legal frameworks governing real estate contracts of sale, deeds, and mortgages, and covers in greater depth and detail all aspects of typical real estate purchase and lease transactions. The fundamental legal principles of contract, tort and real property law are applied to a typical purchase and sale of a commercial property and a store lease, with attention to details of due diligence, drafting, review and negotiation of agreements, deeds, title insurance, customs in respect of closings and professional ethics. The course provides an in-depth examination of Contracts of Sale, Brokerage Agreements, Intercreditor Agreements, Surveys, Title Insurance Policies, Mortgages and Notes, Leases and Lease Guaranties.
