This course will analyze the various laws and regulations that apply to the global energy field, with special emphasis on how the energy business is regulated by the CFTC, FERC, SEC, and teh FTC in the U.S. and by other governmental agencies located outside the U.S. It will analyze the different enforcement proceedings that may be brought, how fraud and market manipulation claims are brought, and how regulations affect the different trading strategies involved. Also, it will give an understanding of the energy derivatives products traded in today's markets, the regulated exchanges such as NYMEX, DME, IPE, UKPX as well as the agreements under which both financially and physically settled energy transactions are traded: Gas Annex and Power Annex of the ISDA Agreement, the NAESB, EFET, EEI, GMTA & ZBT. Students will participate in negotiating agreements, drafting enforcement pleadings, and negotiating enforcement action settlements.
