On behalf of the New York Law School Moot Court
Association and the entire New York Law School community, we cordially
invite you to serve as a judge of the 35th Robert F. Wagner National Labor
& Employment Law Moot Court Competition. The Wagner Competition is the
nation’s largest student-run moot court competition and the only
national competition dedicated exclusively to the areas of labor and
employment law.
This year’s competition authors, Edmond
Polatschek and Kyle Kunst, developed an original and challenging fact
pattern. The first issue addresses employee privacy rights when dealing
with on-line social networking platforms. This issue focuses on the
Supreme Court’s holding in City of Ontario v. Quon, which held that
the search of a police officer’s text messages sent over a
government-issued cell phone to private parties was reasonable, and not a
violation of the Fourth Amendment. The second issue focuses on the
successorship doctrine of labor law. At issue is whether or not, and to
what extent, a successor company will be bound by a collective bargaining
agreement entered into by a predecessor company. The fact pattern
outlining these issues was released to competitors and judges on January
10, 2011, and is available at www.nyls.edu/wagner.
Specialized knowledge of labor and employment law is not necessary to be
a judge in this competition. The fact pattern co-authors are hard at work
on a bench memorandum which will provide all the information you need to
judge. As the competition nears, judges will receive a copy of this bench
brief.
In addition to engaging with students from fifty law
schools about emergent legal issues, you may also obtain up to two
Continued Learning Education (“CLE”) credits, one for each
round you judge. We can only grant a maximum of two CLE credits per
person, but welcome your participation in as many rounds as you would like
to attend.
