Explores the main procedural issues posed by the shift from local transactions to globalization, by focusing on three main problems: (1) under what circumstances can two or more states (or countries) exercise jurisdiction over the same dispute, and how can such competing claims be resolved; (2) when are the substantive laws of two or more states (or countries) applicable to the same dispute and what methods are used for choosing among these potentially applicable laws, and (3) under what circumstances can a judgment awarded by one court be enforced in another state or country? Underlying these questions is a central legal issue posed by the internationalization of legal practice: will courts and legislatures of different jurisdictions cooperate or compete?
