Recently proposed rules by the U.S. Securities and Exchange Commission will not only require enhanced disclosures on environmental, social, and governance (ESG) investment practices and strategies, but also update how investment companies can market funds that use ESG factors. Brian Fortune ’96 and Adele Kittredge Murray ’96 will give an overview of these proposals, describe their possible impact on asset managers when they approach ESG investing, and discuss whether there is a fiduciary duty to assess and use ESG considerations when making investment decisions.
