In the absence of a single global standard, multinational businesses facing financial distress need a coordinated restructuring plan that works across courts in different countries. Among other choices, companies that select a foreign forum can use Chapter 15 of the U.S. Bankruptcy Code, which is designed to manage cross-border insolvency cases and provides a legal framework for managing debts and assets involving multiple countries. This program will explore these options, discuss the contours of Chapter 15, and examine its use in French conciliation and restructuring proceedings.
