Leaders of the mediation programs of the Southern District of New York, the Eastern District of New York, and the Second Circuit Court of Appeals join this roundtable discussion of how mediation works in their court, answering questions such as: Who are the mediators? Do non-staff mediators get
paid? What are the consequences of failure to mediate in good faith? What are the statistical outcomes of court-ordered mediation, and how do those outcomes compare with private, voluntary mediation? What changes might be expected now that virtual mediation is so frequently practiced and so broadly accepted?
