Platform Liability and Regulation
This course examines the doctrine and policy of when and how we hold technology companies and online platforms liable for harms. Starting with Section 230, the course will cover early challenges for platforms engaging in content moderation, including recent changes in case law and legislation, such as social media addiction cases and age verification. We will then explore how the platform liability can differ for specific types of content, including non-consensual intimate images, marketplace liability for products, copyright infringement, and trademark infringement. We will also discuss emerging liability questions related to emerging technologies, including generative AI and deepfakes.
Following introductions to each area of law by the professor, the class time will be largely comprised of student-led discussions under the professor’s guidance. Different students will be assigned as discussion leaders for specific classes. There will be short written responses due during the semester. Students are expected to complete a final paper (about 15-20 double-spaced pages) on a related topic of their choice.
