Under the Freedom of Information Act (FOIA) in the United States and its counterpart in France (called CADA), anyone may request access to records held by any government agency with narrow exceptions (national security, personal privacy, criminal investigations, etc.). Both FOIA and CADA statutes also allow for lawsuits if the government improperly withholds information. This lecture will give a practitioner-oriented overview of FOIA in the United States and CADA in France and compare FOIA/CADA-related litigation in both countries.
