As modern technology evolves, so do the challenges of applying the Fourth Amendment constitutional protections against digital searches. From smartphones to internet searches, courts and policymakers are grappling with how to assess government surveillance of digital data. This panel will explore the intersection of privacy, criminal procedure, and technological advances, including topics such as how courts are assessing the constitutionality of new surveillance technology and when warrants such as geofence warrants are required for digital searches, as well as the various privacy implications.
