To obtain financial records, witness statements, and corporate information located in the United States, parties in foreign lawsuits may, under 28 U.S.C. §1782, access the broad discovery tools normally available only to U.S. litigants by making an application to the district court where the discovery is to be found. In this lecture, the speakers will discuss how to gain access to U.S. discovery under 28 U.S.C. §1782, how U.S. counsel can help submit a successful application, and how best to handle possible challenges from respondents and discovery targets.
