Higher Education Law and Policy

This course introduces students to the legal and policy frameworks that govern higher education in the United States. Through case law, statutes, regulatory developments, and current controversies, students will examine the legal rights and responsibilities of institutions, faculty, staff, and students. Topics will include academic freedom, Title IX and other major civil rights statutes, free speech and protest, accreditation, government oversight, and the regulation of independent and for-profit institutions.

This is an introductory course on American higher education. Through the course, students will do the following:

  1. Gain foundational knowledge of key legal issues impacting U.S. higher education.
  2. Analyze and interpret legal authority, including cases, statutes, and regulations.
  3. Engage in critical discussion of real-time controversies affecting universities and law schools.
  4. Develop legal and policy analysis skills through short written reflections and a final project.
